OFFICIAL RULES

NO PURCHASE OR SUBMISSION TO SALES PRESENTATION NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED BY LAW. PLEASE READ THESE RULES CAREFULLY. AS EXPLAINED BELOW, THE RULES REQUIRE THAT DISPUTES ARISING OUT OF OR RELATING TO THIS CONTEST BE RESOLVED IN ARBITRATION ON AN INDIVIDUAL BASIS, RATHER THAN BY CLASS ACTIONS OR JURY TRIALS, AND LIMIT YOUR RIGHTS AND REMEDIES IN THE EVENT OF A DISPUTE.

1. Contest/Entry Period: The “2025 Back to School Lunchbox Design Contest” (“Contest”) commences at 9 A.M. Eastern Standard Time (“EST”) on July 11, 2025 and ends at 11:59 P.M. EST on September 4, 2025 (“Contest Period”). However, the entry period for submissions into the Contest shall commence at 9 A.M. EST on July 11, 2025, and ends at 11:59 P.M. EST on August 7, 2025 (“Entry Period”). All entries must be received by the end time and date of Entry Period to be eligible for the Contest. Individuals who submit an entry during an Entry Period will be receiving an entry for Contest.

The Administrator’s computer is the official time keeping device for this Contest. All Contest entries must be received prior to the conclusion of the Contest Period. All interpretations of these Official Rules and decisions made by Sponsor relating to the Contest are final.

2. Who May Enter: Contest is open to legal residents of the fifty (50) United States and the District of Columbia, who are at least the age of majority in their state of residence at the time of entry. Employees, officers, directors and assigns of Cricket Wireless LLC (“Sponsor”), You Are Here, LLC (“Administrator”) and each of their respective parents, affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, and promotion agencies, and any and all other companies associated with the design or execution of this Contest (collectively, “Released Parties”), and the members of the immediate families (spouse, parent, sibling and child and their respective spouses, regardless of where they reside) or households of any of the above, whether or not related, are not eligible to enter or win. Void where prohibited. Contest is subject to all applicable federal, state and local laws.

By participating in this Contest, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Official Rules; (c) represent and warrant that he or she meets all the eligibility criteria set forth in these Official Rules; (d) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (e) agree to release and hold harmless the Released Parties and their respective parents, subsidiaries, affiliates, agents, officers, directors and employees from and against any and all claims, injury or damages arising out of or relating to participation in Contest and/or the use, misuse or redemption of the prizes (described below), and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related or other cause of action.

3. How To Enter: NO PURCHASE NECESSARY TO ENTER OR WIN. During the Contest Period, (a) visit http://www.cricketsweepstakes.com/LUNCH (the “Site”), and (b) follow the instructions to enter the Contest by: (1) Completing all the required fields on the online submission form including your first name, last name, email, and agreeing to the terms of the Contest; (2) providing the first name, last name, name of school and the requested contact information of the educator you have nominated (“Nominated Educator”) (3) acknowledge and accept your submission to this Contest constitutes agreement of these Official Rules and these Official Rules form a binding legal agreement between you and Released Parties, and (4) Following the instructions to submit your original artwork of a lunchbox (“Lunchbox”) design utilizing Sponsor-provided creative assets (“Creative Assets”), during the Entry Period. The design must also be in compliance with these Official Rules and the Submission Guidelines detailed in Section 4 below. Entrant will receive a confirmation sent to the email provided once the artwork has been submitted.

All contents of entrant’s Contest entries, including, but not limited to, content, text, images, graphics, photographs, recordings, voice, captions and descriptions, data, codes, programs, are hereinafter referred to as “Submission(s).” All Submissions submitted in compliance with these Official Rules and not disqualified are considered “Eligible Submissions.” All Submission materials become the sole and exclusive property of Sponsor. Submissions will not be returned. Proof of submission will not be deemed to be proof of receipt of Submission by Sponsor.

Contest Submissions are subject to validation by the Administrator. By taking part in this Contest you agree to be bound by these rules and all decisions of the Administrator and Sponsor which are final and binding on all aspects of the Contest. Sponsor is not responsible for lost, interrupted or unavailable network server or other connection; miscommunications; failed phone or computer or telephone transmissions; technical failure; jumbled, scrambled or misdirected transmissions; late, lost, incomplete, delayed, or misdirected submissions; or other error of any kind whether human, mechanical, or electronic. There is no limit to the number of times a person may enter the Contest during the Contest Period, however each entry must include unique original artwork and a unique Nominated Educator. False or deceptive acts or submissions, or submissions generated by script, macro or other automated means will be void, will render a participant ineligible, and also may result in participant no longer being allowed to enter Sponsor's Contest, contests or other promotions in the future, at Sponsor’s sole discretion. You must provide all information requested. Incomplete, unreadable, or unintelligible submissions will be disqualified. The entrant’s artwork and/or Nominated Teach may be featured and accessible to be viewed on the Contest Site once the artwork and the Nominated Educator have been approved by the Sponsor and/or Administrator to be in compliance with the Official Rules and Submission Guidelines provided on the Contest entry page and in Section 4 below. By submitting artwork and nominating the Nominated Educator, entrant understands and agrees that their Submission and the Nominated Educator may be publicly displayed in the manner set forth above without any further notification to or consent from entrant. Notwithstanding the foregoing, the Nominated Educator shall be required to complete a release form providing their consent to be bound by the rules of this Contest and verify the information provided by the entrant. Entrant agrees that Sponsor may use his/her Submissions including, but not limited to, the submitted artwork and entrant’s first name, in whole or in part, for any purpose whatsoever, throughout the world, in any and all media now known or hereafter developed, in perpetuity, without any additional compensation. Sponsor is not obligated to use, publish, display or broadcast any Submission. Entrant agrees that Released Parties are not responsible for any unauthorized use of Submissions by any third parties. Sponsor is not obligated to use, publish or display or broadcast any Submission, regardless of whether the Submission is a winning Submission. All information submitted by entrants is subject to and will be treated in a manner consistent with Sponsor’s Privacy Policy accessible at https://www.cricketwireless.com/privacy. By participating in this Contest, you hereby agree to Sponsor’s collection and usage of your personal information and acknowledge that you have read and accepted Sponsor’s Privacy Policy.

Participation in the Contest constitutes your understanding of full and unconditional agreement to, and acceptance of these Official Rules. Sponsor reserves the right to disqualify any entrant that Sponsor determines in its sole discretion to be: (i) in violation of any term contained in these Official Rules; (ii) if you or Nominated Educator has committed a violation of any law, rule or regulation, or if your or Nominated Educator’s conduct, in Sponsor’s reasonable discretion, violates generally accepted standards of behavior, such that public association with you or Nominated Educator would subject Sponsor or Administrator to the disfavor, contempt or ridicule of the general public, or would be detrimental to the reputation, business and/or sale of the products or services of Sponsor, Administrator, or that is reasonably likely to insult or offend the community or any substantial group thereof; (iii) or if Sponsor reasonably believes the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, or other unfair practices. Sponsor may request entrant to modify or edit any Submission so that it meets these Official Rules. Sponsor's decision not to enforce a specific provision of these Official Rules does not constitute a waiver of that provision or of the Official Rules generally.

Should Sponsor choose to select your Contest Submission for promotional purposes (whether or not you are chosen as a Winner or Finalist of the Contest), your Contest Submission may be used by Sponsor in any form of media, in perpetuity, throughout the universe, without additional compensation or consideration or notification, for the purposes of promoting and advertising the Contest.

In the event of a dispute over who submitted a Submission, the authorized account holder of the email address used to register will be deemed to be the entrant. The authorized account holder is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The potential Winner may be required to show proof of being an authorized account holder. In the event a winning account selected is a joint account, a total of one (1) Prize will be awarded in the name of the first-named account holder.

4.Submission Guidelines: In addition to the requirements set forth herein, the Submission must comply with the following requirements:

  1. The Submission can only depict persons of the age of majority in their state of residence at time of entry: eighteen years of age in most states, nineteen in Alabama and Nebraska, twenty-one in Mississippi. A Minor may be featured in the artwork only if the Contest entrant is said Minor’s parent or legal guardian. Entrant is responsible for securing all applicable rights, licenses, and/or permissions to depict all individuals in the submitted artwork and to otherwise comply with the requirements of these Official Rules.
  2. Artwork must be created using the provided Creative Assets and submitted through the Site.
  3. The Submission may not contain any content that is lewd; obscene; sexually explicit; pornographic; disparaging; defamatory; libelous; violent; or derogatory of any ethnic, racial, gender, religious, professional or age group or that otherwise contains inappropriate content or objectionable material as determined by Sponsor in its sole and unfettered discretion.
  4. The Submission may not show or promote unlawful activities or any activities that may appear unsafe or dangerous, including any reference to drugs or alcohol use and/or abuse.
  5. The Submission must be the original work of the entrant, created solely by the entrant, created without the assistance of any artificial intelligence program, and must not infringe the copyright, trademark, privacy, publicity, or other intellectual rights of any person or entity.
  6. The Submission must not contain any personally identifiable information of entrant or any other person. Personally identifiable information (PII) includes, but is not limited to name, license plates, phone number and personal address.
  7. Entrants may not be, nor may entrant, work with parties in conjunction with their artwork Submission, who: (1) are represented under contract (e.g., by a talent agent or manager) that would limit or impair Sponsor’s ability to display the Submissions in any media form; or are under any other contractual relationship, including but not limited to guild and/or union memberships, that may prohibit them from participating fully in this Contest, or from allowing Sponsor to use royalty-free, the Submissions worldwide in all media in perpetuity.
  8. The Submission must not contain any commercial content or logos, except those of Sponsor.
  9. The Submission may not contain any material or elements that are not owned by the Entrant and/or which are subject to the rights of third parties. For purposes of clarity, the use of the Creative Assets is permitted.

Sponsor reserves the right to disqualify any Submission that it deems, in its sole discretion, (a) to be a violation of the Official Rules; or (b) that is not in keeping with the Submission Guidelines specified herein or Sponsor’s image; or (c) which communicate messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate. Sponsor may request entrant to modify or edit any Submission so that the Submission meets these Submission Guidelines. Sponsor is not obligated to use, publish or display or broadcast any Submission.

Entrants acknowledge and agree that Sponsor may receive many Submissions in connection with this Contest and that some Submissions may be very similar in content, idea, theme, or in other respects to other Submissions received or submitted. Each entrant waives any and all claims entrant may have had, may have and/or may have in the future, that any Submission in this Contest is similar to his/her Submission, or that any compensation is due to entrant in connection with such Submission.

5. Use of Submissions: Sponsor, in its sole discretion, may post the entrants’ Contest Submission(s) on the Site and other Sponsor affiliated websites.

Entrants agree that Sponsor may use their Submissions including, but not limited to, entrant’s first name and city and/or state of residence, in whole or in part, for any purpose whatsoever without any additional compensation. Entrants agree that Sponsor and Administrator are not responsible for any unauthorized use of Submissions by any third parties. 

All entrants agree that in exchange for their participation in the Contest they grant, and have full right to grant, Sponsor, Administrator and their respective representatives, affiliates, licensees, successors and assigns; (a) the right, but not the obligation, to use, edit, adapt, reformat, rearrange, modify, combine with other pictures, items and/or materials, add to and/or customize Submission; and (b) the non-exclusive, irrevocable, royalty free, right and license to use, exhibit, display, broadcast, copy, reproduce, encode, compress, encrypt, incorporate data into, rebroadcast, transmit, record, publicly perform, create derivative works of, distribute and synchronize in timed relation to visual elements, and or otherwise exploit, the Submissions, and/or any portions or excerpts thereof, including, without limitation, using entrant’s name, image, likeness, performance, voice and any other attributes of entrant, individually or with others, in whole or in part, in conjunction with other material, in any manner, for any purpose, including, but not limited to, advertising, promoting and publicizing Sponsor and Administrator, an unlimited number of times, in any and all media, now known or hereafter devised, in perpetuity, throughout the world, without any additional liability, obligation or additional payment of any kind to entrant or any third party.

Entrants agree to obtain, upon request from Sponsor and/or Administrator, any documentation necessary to prove their unrestricted ownership in all contents of Submission and their right to use Submission as specified in these Official Rules. Entrants also acknowledge and agree that Sponsor and Administrator shall own all right, title and interest, including all copyright ownership, in any derivative works Sponsor or Administrator may create from any element of Submission.

6.Judging and Determination of Winner: Throughout the Contest Period, Sponsor and Administrator will monitor and review the Submissions for eligibility and compliance with the Official Rules, including the verification of the Nominated Educator’s identity and receipt of the Nomiated Educator’s release and consent to be bound by the rules of this Contest. At the end of the Entry Period a panel of qualified judges (the “Judges”), determined by Sponsor and/or Administrator in their sole discretion, will review and select finalists (each a “Finalist”) based on the highest scoring Submission from among all Eligible Submissions received during the corresponding Entry Period. The number of Finalists shall be determined by Sponsor in its sole discretion. The Judges will judge the Submission based on the following criteria: (1) Artistic use of the Creative Assets (50%); (2) Creativity and Originality (40%); and (3) Fun factor (10%).

The Finalists will have their Eligible Submission and the Nominated Educator’s first name, last initial, city, and state displayed on the Site. Users of the Site will have the ability to vote for their favorite Finalist. The twenty (20) Finalists with the highest number of votes will be determined to be the winners (“Winners”) (assuming said Finalist has complied with all other requirements of these Official Rules). In the event of a tie, Judges will select the Winner based upon the Finalist that had a higher score in the Creativity category. The determination of the Winner shall be made by the Judges, and such determination shall be final and binding. The Judges’ scores for each Submission shall not be revealed to the public.

In the event that a potential Winner is disqualified for any reason, Sponsor may, in its sole discretion, award the Prize (as defined in Section 9) to an alternate Winner by selecting the next highest scoring Finalist. In addition, Sponsor reserves the right to select an alternate Winner in the event that any potential Winner fails to comply with these Official Rules.

Sponsor and Judges disclaim any liability from any entrant and entrants agree to waive any claims against Sponsor and Judges relating to the judging or awarding process.

7.Winner Selection and Notification: Sponsor will notify each Winner on or around Sepember 5, 2025. Sponsor will make up to three (3) attempts over the forty-eight (48) hour period following each Winners’ selection to contact the potential Winners via email. If a potential Winner cannot be reached directly during the forty-eight (48) hour period in which he or she is contacted, the potential Winner will be disqualified and in Sponsor’s sole discretion an alternate potential Winner may be chosen using the alternate Winner selection process described in Section 6 above.

8.Winner Verification: To be eligible to be declared a Winner, and to receive the applicable Prize, the potential Winner and the potential Winner’s Nominated Teach must sign and return to Sponsor, within three (3) days of issuance of such documentation from Sponsor, an Affidavit of Eligibility and Release that: (i) releases Released Parties from any and all liability, loss, claims, demands, and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss, or any other harm suffered directly or indirectly from potential Winner’s or Nominated Educator’s participation in Contest, including, but not limited to, the acceptance, possession, or use or misuse of any Prize; (ii) except where prohibited by law, grants Sponsor the right to use potential Winner’s or the Nominated Educator’s name, picture, attributes, social media handle(s), likeness, biographical information, voice, and/or any other identifying attributes of Winner or the Nominated Educator’s for trade, advertising and publicity purposes, in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration or notification; (iii) grants a non-exclusive, irrevocable, royalty free, license, in perpetuity, commencing at Contest entry granting Sponsor and its designees the right to use the Winner’s Submission(s) as specified herein; and (iv) any other release deemed necessary by Sponsor in its sole discretion (including, but not limited to, background check authorization forms if required by Sponsor). Entry into Contest constitutes agreement to sign such release(s). If potential Winner or the Nominated Educator does not sign the release and return it within the time frame specified, the potential Winner may be disqualified, at Sponsor’s sole discretion, and the Prizes forfeited. When such documentation is properly executed, and the results of a background check on the potential Winner and/or Nominated Educator are acceptable to Sponsor (if Sponsor requests said background check) and providing said potential Winner is otherwise in compliance with the Official Rules, then said potential Winner will be determined to be the Winner. For the purposes of clarity and the avoidance of doubt, any Winner’s Nominated Educator shall be bound by the very same rules of this Contest as if the Nominated Educator were an entrant, Finalist, and/or Winner.

Winner and/or Nominated Educator must also complete any additional legal documents provided by Administrator or Sponsor with respect to the Prizes and return them as instructed within the time frame specified or Winner and/or Nominated Educator may forfeit Prize at Sponsor’s sole discretion. Prize or Prize documents returned as undeliverable will result in forfeiture of Prize. Sponsor expressly reserves the right to delay the announcement of the Winner for any reason Sponsor deems necessary. In addition, Sponsor reserves the right to select an alternate Winner in the event that any potential Winner fails to comply with these Official Rules or fails to execute the documentation within the time frame specified.

9.Grand Prize (3): a Grand Prize consists of two (2) collections of prizes, one (1) for each Winner and one (1) for each Winner’s Nominated Educator. The Winner shall receive the following items (collectively, the “Winner’s Prize”): (i) one (1) giftcard for $500.00, and (ii) one (1) Lunchbox designed using the Winner’s artwork, The Winner’s Nominated Educator shall receive the following items (collectively, the “Educator’s Prize”): (i) one (1) gift card for $500.00, and (ii) one custom Lunchbox, (iii) $500 worth of classroom snacks, and (iv) twenty-five (25) lunchboxes for their classroom using the Winner’s artwork.

Approximate Retail Value (“ARV”) of one (1) Grand Prize: $2,000.00. Actual value of the Grand Prize may vary based on point of departure. The ARV of one (1) Winner’s Prize is $600.00. The ARV of one (1) Educator’s Prize is $1,400.00. Any difference between stated value and actual value will not be awarded. The Grand Prize will be forfeited if Winner or Nominated Educator fails to comply with the terms and conditions of these Official Rules.

All costs and expenses related to acceptance of the Winner’s Prize and the Educator’s Prize and use not specified herein as being awarded shall be the sole responsibility of the Winner and Nominated Educator. respectively, including, but not limited to, all federal, state and local taxes, incurred by the Winner or Nominated Educator. Prizes are non-transferable and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute any prize with one of comparable or greater value, at its sole discretion. Total ARV of all Contest prizes: $6,000.00. The dates for fulfillment of the prizes are subject to change in Sponsor’s sole discretion. Sponsor reserves the right to modify the Contest in its sole discretion and award a substitute prize, or portion of prize, of comparable or greater value as set forth in these Official Rules.

PRIZES ARE PROVIDED “AS IS”. ENTRANTS ACKNOWLEDGE THAT RELEASED PARTIES HAVE NEITHER MADE NOR ARE IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE PRIZES AND ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Prizes pictured in online, television, print advertising, and other Contest materials are for illustrative purposes only. Arrangements for the fulfillment of the prizes, including all travel arrangements, will be made by Administrator and/or Sponsor.

If Winner is not available or able to accept the Prize, Winner privileges will be terminated, and an alternative Winner may be selected from among the remaining Eligible Submissions received. Winner and Winner’s Nominated Educator must supply Sponsor with a complete and valid IRS Form W-9 prior to receiving their respective portion of a Grand Prize. The value of a prize is taxable to the Winner and Nominated Educator as income. An IRS Form 1099 will be issued in the name of the Winner an Nominated Educator for the actual value of the respective prize awarded to them if the aggregate value of the prize awarded to and other compensation received by the Winner or Nominated Educator from Sponsor is $600 or greater for the calendar year. All federal, state and local taxes, and any other costs and expenses associated with acceptance and/or use of the prize not specifically provided for in these Official Rules are solely each Winner’s and Nominated Educator’s responsibility.

10. Publicity Release: By participating in the Contest, each Winner and each Winner’s Nominated Educator (i) by acceptance of a prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval and (ii) grants the right to Sponsor, and its representatives, affiliates, licensees and assigns, to record, film, videotape and photograph the Winner or the Winner’s Nominated Educator (“Images”). These Images will be owned by Sponsor. Sponsor and each of its designees shall have the right to use, re-use, reproduce, publish, display, exhibit, distribute, edit, adapt, post, stream, copy and exploit such Images, and all elements embodied therein, including any names, likenesses, address, voice, conversation, biographical and prize information and any other attributes of the Winner and/or Winner’s Nominated Educator, individually or with others, in whole or in part, in conjunction with other material, if any, in any and all media now known or hereafter devised, for the purpose of trade, advertising, publicity, promotion, or a Contest winner list or any other lawful purpose whatsoever, in perpetuity, throughout the world, without additional compensation, consideration, notification or permission, except where prohibited by law.

11. Additional Rules & Restrictions: By participating in this Contest, participants agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all matters relating to this Contest. If a Winner and/or the Winner’s Nominated Educator is found to be in violation of any of these Official Rules, he/she will be required to forfeit the prize(s). Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, illegible or delayed entries, or prize claims; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing of entries, the announcement of the prizes, the cancellation of any Contest event, the cancellation or postponement of any event, or in any Contest-related materials. In the event any event or portion of the prize is unavailable, delayed, postponed or cancelled for any reason, including, but not limited to, any government restriction, public health threat, or similar circumstance associated with the COVID-19 pandemic or its mutations or emerging variations, such portion of the prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Sponsor expressly reserves the right to delay the announcement of the Winners for any reason Sponsor deems necessary. In addition, Sponsor reserves the right to select an alternate Winner in the event that the potential Winner or the potential Winner’s Nominated Educator fails to comply with these Official Rules or fails to execute any documentation requested by Sponsor within the time frame specified. By participating in Contest, the Winner and the Winner’s Nominated Educator acknowledge that the Released Parties have not and will not obtain or provide insurance of any kind relating to the prizes and that the Winner and the Winner’s Nominated Educator will be responsible for obtaining and paying for any form of insurance relating to the prize that the Winner and/or Winner’s Nominated Educator deem appropriate.

Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the Site. Persons who tamper with or abuse any aspect of the Contest or Site or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Contest and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants, by participating, agree that Released Parties will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize (including any travel/activity related thereto) or participation in this Contest. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a termination of the Contest, a notice will be posted on the Site and, in Sponsor’s sole discretion, prize(s) may be awarded to Winner(s) and each Winners’ Nominated Educators to be selected in a random drawing from among all of the remaining uncorrupted applicable eligible entries received prior to any such event.

12. Arbitration: Except where prohibited by law, as a condition of participating in this Contest, entrants agree that (1) any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, and not as a participant in any class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs directly attributable to participating in this Contest), and entrant further waives all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by and construed in accordance with the substantive laws of the State of Georgia, USA.

13. Request for Name of Winners and Official Rules: All requests for a copy of the Official Rules and for the name of the Winners (first name and state only) must be made by December 31, 2025. For the name of the winner and/or Official Rules: (i) send a self-addressed stamped envelope to: You Are Here, LLC, Attention: 2025 Back to School Lunchbox Design Contest presented by Cricket Wireless, 150 Interstate North Parkway, Atlanta, Georgia 30339; and (ii) write, as applicable, “Winner List” or “Official Rules” on the lower left hand corner of the envelope.

15. Administrator: This Contest is administered by You Are Here, LLC, 150 Interstate North Parkway, Atlanta, Georgia 30339.

16. Language: Sponsor, in its sole discretion, may reproduce these Official Rules in multiple languages. The English version of these Official Rules shall prevail and govern the Contest in all matters whatsoever.

17. Notice of Financial Incentive: This Contest may be considered a financial incentive under state privacy laws. For example, you may be entered into the Contest when you provide certain personal information to us, including your contact information and your survey responses. The personal information provided will be collected, used, and disclosed in accordance with the Cricket Privacy Notice. By registering for and participating in the survey, you are opting in to potentially receiving the financial incentive. You may opt-out of the financial incentive at any time by cancelling your participation in the Contest or not providing your personal information. The financial incentive related to submission and use of personal information is based upon our reasonable good faith estimate of the value of such information, which takes into consideration various factors such as anticipated revenue generated, anticipated expenses incurred for the collection, storage, and use of such information, and other relevant factors related to the estimated value of such personal information to our business.
